These Terms and Conditions ("Agreement") govern the use of the DK&E Academy — The Lyceum website, educational programs, memberships, subscriptions, digital products, services, and related offerings (collectively, the "Services"). This Agreement is entered into between you ("User," "Student," "Member," or "you") and DK&E Business Group, LLC ("The Academy," "we," "us," or "our"), an Illinois limited liability company operating its educational division under the trade name DK&E Academy — The Lyceum. By accessing this Website, creating an account, enrolling in any course, program, membership, subscription, certification pathway, digital product, or other Service offered by The Academy, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions and any policies incorporated herein by reference. If you do not agree to these Terms and Conditions, you must immediately discontinue use of the Website and refrain from accessing or purchasing any Services. Enrollment, registration, purchase, or participation in any Service constitutes acceptance of this Agreement and creates a legally binding contract between you and DK&E Business Group, LLC. Confirmation of enrollment, registration, or purchase will be sent to the email address provided during registration. You are responsible for maintaining accurate and current contact information. Legal Entity Disclosure DK&E Business Group, LLC is an Illinois limited liability company. DK&E Academy — The Lyceum is a trade name and educational division operated by DK&E Business Group, LLC and is not a separate legal entity. All rights, responsibilities, contractual obligations, transactions, and legal relationships arising from the Services are entered into by and through DK&E Business Group, LLC.

1. Definitions and Interpretation

In this Agreement, unless the context otherwise requires, the following terms shall have the following meanings:
"Academy" means DK&E Academy — The Lyceum, the educational division and trade name operated by DK&E Business Group, LLC.
"Account" means collectively the personal information, Payment Information, login credentials, enrollment records, and other information used by Users to access Services, Courses, Paid Content, Certificates, Digital Resources, and/or any communications System on the Website.
"Certificate" means a certificate of completion, achievement, participation, or similar recognition issued by the Academy upon satisfaction of specified requirements.
"Content" means any text, graphics, images, logos, trademarks, audio, video, software, data compilations, learning materials, and any other form of information capable of being stored in a computer that appears on or forms part of this Website.
"Course" means any educational program, training, workshop, membership, subscription, certification pathway, digital product, resource library, coaching offering, or other learning experience provided by the Academy.
"Digital Resources" means any downloadable or online educational materials provided by the Academy, including but not limited to templates, spreadsheets, forms, checklists, practice datasets, guides, workbooks, toolkits, and reference materials.
"Facilities" means collectively any online facilities, tools, services, resources, applications, information, or functionality that DK&E Business Group, LLC makes available through the Website either now or in the future.
"Payment Information" means any details required for the purchase of Services, Courses, Memberships, Digital Resources, or other offerings from this Website. This includes, but is not limited to, credit card numbers, debit card numbers, billing information, and bank account information. "Premises" means Our principal place of business located in Illinois.
"Services" means the educational, informational, training, membership, subscription, digital, and support services available to you through this Website, specifically including the Academy's proprietary e-learning platform and related offerings.
"System" means any online communications infrastructure that DK&E Business Group, LLC makes available through the Website either now or in the future. This includes, but is not limited to, written Q&A facilities, discussion forums, message boards, community features, webinars, livestreams, messaging systems, and email links.
"User" or "Users" means any third party that accesses the Website and is not employed by DK&E Business Group, LLC and acting in the course of their employment.
"Website" means the website currently operating under the domains owned or controlled by DK&E Business Group, LLC, including dkande.com and any associated sub-domains, learning platforms, student portals, or related websites, unless expressly excluded by their own terms and conditions.
"We", "Us", "Our", "Company", or "The Academy" means DK&E Business Group, LLC, a limited liability company registered in the State of Illinois and doing business as DK&E Academy — The Lyceum. In this Agreement:
a. words importing the singular number shall include the plural and vice versa;
b. references to any gender shall include all genders;
c. headings are provided for convenience only and shall not affect the interpretation of this Agreement;
d. references to any statute, regulation, or legal authority shall include any amendment, modification, extension, re-enactment, or replacement thereof; and e. the words "including", "includes", and "such as" shall be deemed to mean "including without limitation".

2. Age Restrictions

The Website and Services are intended for individuals who are at least eighteen (18) years of age.
Persons under the age of eighteen (18) may access the Website only under the supervision and consent of a parent or legal guardian. Any Payment Information submitted in connection with the purchase of Services by a person under the age of eighteen (18) must be provided by, or with the express authorization of, a parent or legal guardian.
Enrollment in any Course, Membership, Subscription, Certificate Program, Certification Pathway, or other paid Service offered by the Academy is restricted to individuals who are at least eighteen (18) years of age.
By creating an Account, enrolling in a Course, purchasing Services, or otherwise using the Website, you represent and warrant that you meet the eligibility requirements set forth in this Section.

3. Business Customers

These Terms and Conditions apply equally to individuals purchasing Services for personal use and to businesses, organizations, employers, or other entities purchasing or procuring Services for business, professional, training, or workforce development purposes. Any person enrolling in, purchasing, or accessing Services on behalf of a business or organization represents and warrants that they have the authority to bind that business or organization to these Terms and Conditions.

4. Intellectual Property

4.1 Ownership of Intellectual Property All Content available on the Website or provided through the Services, including but not limited to Courses, Digital Resources, videos, recordings, workbooks, templates, spreadsheets, forms, guides, assignments, assessments, quizzes, exercises, frameworks, methodologies, systems, case studies, graphics, logos, designs, text, software, and other educational materials, is the exclusive property of DK&E Business Group, LLC or its licensors and is protected by applicable United States and international copyright, trademark, trade secret, and intellectual property laws. By accessing the Website or using the Services, you acknowledge that all such Content is proprietary and protected. The names DK&E Business Group™, DK&E Academy — The Lyceum™, The Bookkeeper Mastery Path™, The Business Owner Operating System™ (BOOS™), The Excel Accounting System™, and any associated logos, slogans, methodologies, program names, or branding elements are proprietary intellectual property of DK&E Business Group, LLC and may not be used, reproduced, displayed, distributed, or otherwise exploited without the prior written consent of DK&E Business Group, LLC.
4.2 Limited License to Use Content Upon enrollment or purchase, Users are granted a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to access and use the Content solely for their own educational and professional development purposes during the applicable enrollment or access period. This license does not confer any ownership rights in the Content and may be revoked by the Academy in accordance with these Terms and Conditions.
4.3 Prohibited Uses Except as expressly permitted in writing by DK&E Business Group, LLC, Users shall not: a. reproduce, copy, distribute, publish, transmit, display, sell, license, sublicense, rent, lease, share, or otherwise exploit any Content; b. modify, adapt, translate, create derivative works from, reverse engineer, or incorporate any Content into another product, course, training program, publication, or service; c. record, download, screenshot, capture, archive, or store any video, audio, webinar, livestream, presentation, lesson, assessment, or other Content except where a download option is expressly provided by the Academy; d. share Account credentials or provide access to any Course, Membership, Subscription, or Digital Resource to any third party; e. remove, alter, or obscure any copyright, trademark, proprietary notice, or other indication of ownership; or f. use Academy Content, methodologies, frameworks, systems, or materials to develop, train, enhance, or support competing educational products, training programs, artificial intelligence systems, machine learning models, or similar technologies.
4.4 Reservation of Rights All rights not expressly granted under these Terms and Conditions are reserved by DK&E Business Group, LLC. No provision of these Terms and Conditions shall be construed as transferring or assigning any intellectual property rights to any User.

5. Third Party Intellectual Property

5.1 Third-Party Intellectual Property The Website and Services may contain references to, demonstrations of, screenshots from, integrations with, or educational discussions about third-party software platforms, applications, products, services, trademarks, trade names, and other proprietary technologies, including but not limited to QuickBooks Online®, Xero®, Toast POS®, Microsoft Excel®, and similar industry tools. All trademarks, service marks, logos, trade names, copyrights, and other intellectual property rights associated with such third-party platforms remain the exclusive property of their respective owners. Nothing in the Website, Services, or Program Content shall be construed as granting any right, title, or interest in or to any third-party intellectual property.
5.2 Educational Use and No Affiliation References to third-party platforms, software, products, or services are provided solely for educational, instructional, illustrative, or informational purposes. Unless expressly stated otherwise in writing, DK&E Business Group, LLC, doing business as DK&E Academy — The Lyceum, is not affiliated with, endorsed by, sponsored by, approved by, or partnered with any third-party software provider, platform, vendor, or service referenced within the Services or Program Content. The inclusion of any third-party name, trademark, product, platform, website, or service does not constitute a recommendation, guarantee, endorsement, or certification by the Academy.
5.3 No Compensation Disclosure Unless expressly disclosed otherwise, DK&E Business Group, LLC does not receive compensation, commissions, referral fees, sponsorship payments, or other consideration in exchange for references to third-party platforms, software, products, or services within its Courses, Programs, Digital Resources, or other Services.

6. Fair Use and Copyright — United States Law

The Content available through the Website and Services is protected under the United States Copyright Act (17 U.S.C. § 101 et seq.) and other applicable federal, state, and international intellectual property laws. Nothing in these Terms and Conditions shall be construed to waive, limit, or impair any intellectual property rights owned by DK&E Business Group, LLC. Any unauthorized reproduction, distribution, transmission, display, performance, publication, modification, or creation of derivative works based upon Academy Content may constitute copyright infringement and may subject the User to civil and, where applicable, criminal liability under United States law. Except as expressly authorized in writing by DK&E Business Group, LLC, Users may not reproduce, redistribute, republish, sell, lease, license, share, or otherwise exploit Academy Content for commercial or non-commercial purposes. The Academy's educational materials, methodologies, templates, forms, spreadsheets, videos, assessments, and other proprietary Content are provided under the limited license described in these Terms and Conditions. The Academy does not consider the copying, redistribution, republication, sharing, or commercial exploitation of such materials by Users to constitute an authorized use of its copyrighted works.

7. Links to Other Websites

The Website and Services may contain links to third-party websites, applications, platforms, resources, software providers, articles, videos, or other external content for informational, educational, or convenience purposes.
Unless expressly stated otherwise, such third-party websites and resources are not owned, operated, or controlled by DK&E Business Group, LLC or its affiliates. DK&E Business Group, LLC has no control over the availability, content, policies, security, accuracy, legality, or practices of any third-party website or resource and assumes no responsibility for them.
DK&E Business Group, LLC shall not be liable for any loss, damage, cost, claim, or expense arising from or related to a User's access to, use of, reliance upon, or interaction with any third-party website, platform, product, service, or resource.
The inclusion of any link, reference, or resource on the Website or within the Services does not constitute or imply endorsement, sponsorship, approval, recommendation, affiliation, or partnership by DK&E Business Group, LLC regarding any third-party website, organization, product, service, operator, owner, or content provider.
Users access third-party websites and resources at their own risk and are encouraged to review the applicable terms, conditions, privacy policies, and practices of any third-party website they choose to visit.

8. Links to this Website

Those wishing to place a link to this Website on another website may do so only by linking to the Academy's home page at dkande.com without prior written permission from DK&E Business Group, LLC. Deep linking to any specific page, Course, Membership, Subscription, student portal, download, Digital Resource, or other internal area of the Website requires the prior express written permission of DK&E Business Group, LLC. No link to this Website may be presented in a manner that is misleading, defamatory, unlawful, damaging to the reputation of the Academy, or that falsely implies any endorsement, sponsorship, affiliation, partnership, or approval by DK&E Business Group, LLC. DK&E Business Group, LLC reserves the right to require the removal of any link to the Website at its sole discretion and without prior notice. For permission requests or inquiries regarding the use of links to this Website, please contact us at boss@dkande.com. 

9. Use of Communications Facilities

9.1 Acceptable Conduct When using any communications System available through the Website or Services, including but not limited to student inboxes, discussion boards, community spaces, messaging features, live sessions, webinars, group discussions, comments, or any other interactive feature, you agree to conduct yourself in a professional, respectful, and lawful manner consistent with the standards of DK&E Academy — The Lyceum. Failure to comply with the provisions of this Section may result in the suspension or termination of your Account and access to the Services, with or without notice and without refund, as determined by the Academy in its sole discretion. You agree that you shall not:
9.1.1 use obscene, vulgar, profane, abusive, disrespectful, or otherwise inappropriate language;   9.1.2 submit, post, transmit, or share any content that is unlawful, fraudulent, abusive, threatening, harassing, defamatory, discriminatory, hateful, misleading, or otherwise objectionable;
 9.1.3 submit, post, transmit, or share content that promotes, encourages, or incites violence, hatred, illegal activity, or harmful conduct;
9.1.4 engage in bullying, intimidation, harassment, or disruptive behavior toward other Users, students, instructors, staff members, or representatives of the Academy;
9.1.5 submit assignments, communications, or other materials on behalf of another person or permit another person to participate in the Services using your Account;
9.1.6 use a name, username, profile information, or method of identification that violates these Terms and Conditions or any applicable law;
9.1.7 impersonate any User, student, employee, instructor, representative, or affiliate of DK&E Business Group, LLC;
9.1.8 use any communications System for unauthorized advertising, solicitation, promotion, spam, chain messages, or commercial activities;   9.1.9 upload, transmit, or distribute any malicious code, viruses, malware, or other harmful technology; or
9.1.10 interfere with, disrupt, or attempt to gain unauthorized access to any System, Account, Course, Community, or other portion of the Website or Services.
9.2 Language of Instruction DK&E Academy — The Lyceum welcomes students from diverse linguistic and cultural backgrounds. However, because instruction, evaluation, feedback, and support are conducted in English, all formal communications, assignment submissions, discussion posts, and course-related interactions must be conducted in English unless expressly authorized otherwise by the Academy.
9.3 Monitoring of Communications You acknowledge and agree that DK&E Business Group, LLC reserves the right, but not the obligation, to monitor communications made through or using its Systems for purposes including compliance, quality assurance, security, safety, technical support, and enforcement of these Terms and Conditions.
9.4 Retention of Communications You acknowledge and agree that DK&E Business Group, LLC may retain records of communications, submissions, discussions, messages, and other interactions made through or using its Systems in accordance with its business practices and applicable law.
9.5 Removal of Content You acknowledge and agree that any content submitted through the Website or Services may be reviewed by the Academy. DK&E Business Group, LLC reserves the right, in its sole discretion and without prior notice, to remove, edit, restrict access to, or refuse to publish any content that violates these Terms and Conditions or that the Academy reasonably determines to be inappropriate, disruptive, or inconsistent with the educational mission of the Academy.

10. Accounts

10.1 Account Registration
In order to enroll in any Course, Program, Membership, Subscription, Certificate Program, Certification Pathway, or otherwise access certain Services through this Website, you may be required to create an Account.
By creating an Account and continuing to use the Website or Services, you represent and warrant that:
10.1.1 all information you provide is accurate, truthful, current, and complete;
10.1.2 you have the legal authority to provide any Payment Information submitted through the Website;
10.1.3 you will maintain and promptly update your Account information to ensure its continued accuracy; and
10.1.4 your use of the Website and Services complies with these Terms and Conditions and all applicable laws.
Creation of an Account constitutes your affirmation of these representations and warranties.
10.2 Account Security and Non-Transferability
Your Account is personal to you and may not be sold, assigned, shared, transferred, sublicensed, or otherwise made available to any other person or entity.
You are solely responsible for maintaining the confidentiality of your username, password, and other Account credentials, and for all activities that occur under your Account.
DK&E Business Group, LLC shall not be liable for any loss, damage, unauthorized access, or other consequences arising from your failure to safeguard your Account credentials.
The sharing of Account credentials or Course access with any third party constitutes a material breach of these Terms and Conditions and may result in the immediate suspension or termination of your Account without refund.
10.3 Unauthorized Access
If you know or reasonably suspect that your Account has been accessed, compromised, or used by an unauthorized party, you must notify DK&E Business Group, LLC immediately at boss@dkande.com. 
The Academy reserves the right to suspend, restrict, or terminate access to an Account when unauthorized use is suspected.
10.4 Compliance with Academy Policies
Your username, profile information, Account activity, and use of the Services must comply with the standards set forth in Section 9 (Use of Communications Facilities) and all other provisions of these Terms and Conditions.
Failure to comply with these requirements may result in the suspension, restriction, or permanent termination of your Account, access privileges, Course enrollments, Memberships, or other Services, with or without notice and without refund, at the sole discretion of DK&E Business Group, LLC.
10.5 Ownership of Accounts
All Accounts remain subject to the control and administration of DK&E Business Group, LLC. The Academy reserves the right to refuse registration, suspend access, deactivate Accounts, or terminate Accounts that violate these Terms and Conditions, applicable law, or the educational standards and mission of the Academy.

11. Termination and Cancellation of Accounts

11.1 Termination by the Academy DK&E Business Group, LLC reserves the right to suspend, restrict, or permanently terminate any Account, Course enrollment, Membership, Subscription, or access to Services at any time, with or without notice, for any reason permitted by law, including but not limited to:
11.1.1 violation of these Terms and Conditions; 11.1.2 non-payment of fees or failure to maintain an agreed payment schedule;
11.1.3 conduct determined by the Academy to be inconsistent with the professional standards, educational mission, values, or community expectations of DK&E Academy — The Lyceum; 11.1.4 providing false, misleading, inaccurate, or incomplete information during registration, enrollment, payment, or use of the Services;
11.1.5 unauthorized sharing of Account credentials or Course access;
11.1.6 infringement or misuse of the Academy's intellectual property rights; or
11.1.7 any activity that the Academy reasonably determines to be harmful to other Users, Academy personnel, the Website, the Services, or the reputation of DK&E Business Group, LLC.
11.2 Termination by the User You may request termination of your Account at any time by contacting DK&E Business Group, LLC at boss@dkande.com. Unless otherwise required by law or expressly provided in a separate written refund policy, termination or cancellation of an Account shall not entitle you to a refund of any fees, tuition, Membership payments, Subscription fees, or other amounts previously paid. Any payment obligations outstanding at the time of termination shall remain due and payable.
11.3 Effect of Termination Upon termination of an Account for any reason, your right to access the Website, Courses, Memberships, Subscriptions, Digital Resources, Certificates, Communities, and other Services shall cease immediately unless otherwise determined by the Academy. DK&E Business Group, LLC shall have no obligation to maintain, store, provide, or restore access to any Account data, submissions, assignments, communications, certificates, progress records, or other content associated with a terminated Account.
11.4 Survival Termination of an Account shall not affect any rights, obligations, or liabilities that accrued prior to termination. Any provisions of these Terms and Conditions that by their nature should survive termination shall remain in full force and effect, including but not limited to provisions relating to intellectual property rights, payment obligations, confidentiality, disclaimers, limitations of liability, indemnification, dispute resolution, and governing law.

12. Services, Pricing and Availability

12.1 Description of Services DK&E Business Group, LLC makes reasonable efforts to ensure that all descriptions of Courses, Programs, Memberships, Subscriptions, Digital Resources, Certificates, and other Services offered through DK&E Academy — The Lyceum accurately reflect their content, objectives, and delivery format. However, the exact nature, scope, sequencing, features, timing, and delivery of Services may vary based upon individual enrollment circumstances, cohort size, technological requirements, regulatory considerations, instructional improvements, and ongoing curriculum updates. DK&E Business Group, LLC shall not be responsible for minor variations, revisions, enhancements, or modifications that do not materially alter the overall nature of the Service purchased.
12.2 Enrollment and Payment Confirmation Upon enrollment, you will be required to select and confirm an available payment option, if applicable. Enrollment is not deemed accepted or confirmed until the Academy has received the required payment, approved any applicable payment arrangement, and issued an enrollment confirmation through the email address provided by the User. DK&E Business Group, LLC reserves the right to refuse, reject, limit, or cancel any enrollment prior to confirmation for any lawful reason.
12.3 Availability of Services All Courses, Programs, Memberships, Subscriptions, and other Services are subject to availability. DK&E Academy — The Lyceum intentionally limits enrollment in certain Programs to maintain instructional quality, educational standards, and student support. Enrollment limits, cohort sizes, waitlists, start dates, and availability may be established, modified, or discontinued at the Academy's discretion. The Academy does not guarantee the availability of any specific Program, Course, instructor, enrollment period, start date, or offering at any particular time.
12.4 Pricing All pricing information published on the Website is believed to be accurate at the time of publication. DK&E Business Group, LLC reserves the right to modify, increase, decrease, discontinue, or otherwise adjust pricing for any Service at any time. Any pricing change shall not affect an enrollment that has already been confirmed by the Academy and for which payment has been received or an approved payment arrangement is in effect.
12.5 Pricing Errors and Discrepancies In the event of a pricing error, technical malfunction, typographical mistake, or discrepancy between a published price and the actual price charged by the Academy, DK&E Business Group, LLC reserves the right to correct the error and, where necessary, cancel or adjust an affected transaction. Where a confirmed enrollment has been accepted and an enrollment confirmation email has been issued, the price stated in the enrollment confirmation shall govern unless the pricing discrepancy resulted from an obvious clerical, typographical, or technical error.
12.6 Internships and Practical Experience
Where the Academy offers or references internship, practicum, or practical-experience opportunities in connection with any Program, such opportunities: (a) are subject to eligibility requirements, satisfactory completion of designated coursework, and the Academy's assessment of student readiness; (b) are subject to availability, including the availability and discretion of DK&E Business Group, LLC and any participating partner firms; (c) are not guaranteed to any student; (d) do not constitute an offer of employment, an employment relationship, or a promise of future employment with DK&E Business Group, LLC or any partner firm; and (e) may be modified, substituted — including with supervised practical casework — or discontinued at the Academy's discretion. Completion of an internship or practical experience does not guarantee employment, clients, income, or any professional outcome.

13. Orders and Provision of Services

13.1 Formation of Agreement No part of the Website, Services, Courses, Programs, Memberships, Subscriptions, Certificates, Digital Resources, or related materials constitutes a contractual offer capable of acceptance. Your submission of an enrollment application, registration, purchase request, or payment information constitutes an offer to enroll in and purchase the applicable Services. DK&E Business Group, LLC reserves the right, in its sole discretion, to accept or reject any enrollment request. A legally binding agreement between you and DK&E Business Group, LLC is formed only when the Academy issues an enrollment confirmation to the email address provided during registration.
13.2 Enrollment Confirmation Enrollment confirmation issued pursuant to Section13.1 may include, where applicable:
13.2.1 confirmation of the Course, Program, Membership, Subscription, Certificate Program, or other Service purchased, together with a description of its principal characteristics;
13.2.2 the total program investment and the selected payment option, if applicable;
13.2.3 the enrollment date and commencement of the applicable access period; and
13.2.4 Account credentials, access instructions, or other information necessary to access the Services.
13.3 Non-Acceptance of Enrollment If DK&E Business Group, LLC is unable or unwilling to accept an enrollment request for any reason, including but not limited to program capacity limitations, eligibility requirements, payment issues, or administrative considerations, no binding agreement shall be formed. If payment has been processed before a determination is made that enrollment cannot be accepted, the Academy shall issue a full refund of the amounts paid within fourteen (14) calendar days. This provision applies only to circumstances in which enrollment is not accepted by the Academy and shall not be construed as a refund policy for confirmed enrollments.
13.4 Payment Processing Payment for Services shall be processed using the payment method selected during enrollment. Where a payment plan is offered and selected, the User authorizes DK&E Business Group, LLC and its payment processors to charge subsequent scheduled payments in accordance with the agreed payment arrangement. Failure to maintain required payments may result in restricted access, suspension of Services, or termination of enrollment as provided elsewhere in these Terms and Conditions.
13.5 Access to Services Access to Program content and Services will generally be granted within two (2) business days following enrollment confirmation and receipt of any required payment. DK&E Business Group, LLC shall make reasonable efforts to notify Users of any material delay affecting access to Services.
13.6 Standard of Service DK&E Business Group, LLC shall use reasonable skill, care, and professionalism in the preparation, delivery, and administration of its Courses, Programs, Memberships, Digital Resources, and other Services, consistent with the educational standards of DK&E Academy — The Lyceum.
13.7 Errors and Corrections If a User believes that Program content contains a material error, omission, or technical issue, the User should notify the Academy promptly at boss@dkande.com. DK&E Business Group, LLC will investigate reported issues and, where appropriate, make reasonable efforts to correct verified errors within a reasonable period of time.
13.8 Student support is provided through the communication channels designated by the Academy, including email at boss@dkande.com and any support systems made available through the Website or Services. DK&E Business Group, LLC will make reasonable efforts to respond to inquiries in a timely manner; however, response times may vary based on enrollment volume, staffing, holidays, instructor availability, and other operational considerations. The Academy does not guarantee real-time support, live chat availability, or telephone support unless expressly stated for a specific Program or Service.

14. Cancellation of Orders and Services

14.1 No Refund Policy — Digital Educational Content
All Programs, Courses, Memberships, Subscriptions, Digital Resources, and other Services offered by DK&E Academy — The Lyceum are delivered through a digital online platform.
By completing enrollment, you expressly acknowledge and agree that:
14.1.1 you are purchasing access to digital educational content and Services and are requesting that access begin upon enrollment confirmation;
14.1.2 once access to any Program content, Digital Resource, Membership, Subscription, or other Service has been granted, the Services shall be deemed delivered and commenced;
14.1.3 all payments made to DK&E Business Group, LLC are final and non-refundable once access has been granted, regardless of the extent to which you access, complete, participate in, or utilize the Services;
14.1.4 failure to access, complete, participate in, or successfully finish any Program does not entitle the User to a refund, credit, cancellation, or reduction of any payment obligation; and
14.1.5 the User understands and agrees that enrollment constitutes acceptance of this No Refund Policy.
14.2 Pre-Access Cancellation
If you wish to cancel an enrollment before Account access has been granted, you must notify the Academy immediately at boss@dkande.com.
If cancellation is requested and approved by the Academy prior to the granting of access, any payment received will be refunded in full within fourteen (14) calendar days.
Once access to any Program, Course, Membership, Subscription, Digital Resource, or other Service has been granted, no cancellation or refund shall be available except as expressly provided in this Policy or as otherwise required by applicable law.
14.3 Non-Acceptance of Enrollment
As provided in Section 13.3, if the Academy does not accept an enrollment application, any payment received shall be refunded in full within fourteen (14) calendar days.
This provision applies solely to non-acceptance by the Academy and shall not be construed as a general refund policy.
14.4 Exceptional Circumstances
The Academy may, in its sole and absolute discretion, consider requests for a program credit, transfer, deferment, or similar accommodation in cases involving documented and extraordinary circumstances, including serious medical emergencies or catastrophic hardship.
Any accommodation granted under this Section:
14.4.1 is entirely discretionary;
14.4.2 does not create a legal obligation on the part of the Academy;
14.4.3 shall not constitute a waiver of this Policy;
14.4.4 shall not establish any precedent for future requests; and
14.4.5 may be subject to conditions, deadlines, limitations, and eligibility requirements determined exclusively by the Academy.
No provision of this Section shall be interpreted as creating a right to a refund.
14.5 Payment Plan Obligations
Selection of a Payment Plan constitutes a commitment to pay the full Program investment according to the agreed payment schedule.
Cancellation, withdrawal, non-participation, failure to complete coursework, or termination of access does not eliminate or reduce any outstanding payment obligations.
DK&E Business Group, LLC reserves the right to suspend access to Services in the event of a missed or failed payment while continuing to pursue collection of any remaining balance owed.
14.6 Payment Disputes and Chargebacks
The Academy encourages Users to contact boss@dkande.com before initiating any payment dispute.
If a User initiates a chargeback, payment reversal, or similar dispute relating to Services properly delivered in accordance with these Terms and Conditions, DK&E Business Group, LLC reserves the right to provide documentation of enrollment, acceptance of these Terms, payment records, and access logs in defense of its position and to pursue any legal remedies available for the recovery of amounts lawfully owed.
14.7 Acknowledgment
By completing enrollment, you acknowledge that you have read, understood, and expressly agree to this Cancellation and Refund Policy, and that you are enrolling with full knowledge that payments become non-refundable once access to the purchased Services has been granted.

25. Law and Jurisdiction

These Terms and Conditions, and any dispute, claim, or controversy arising out of or relating to these Terms and Conditions, the Website, the Services, or the relationship between you and DK&E Business Group, LLC, shall be governed by and construed in accordance with the laws of the State of Illinois, United States of America, without regard to its conflict of law principles.
